Constitution of India, Articles 14 and 15 - Education - Admission - Reservation of seats for Backward Class candidate - Offering such seat to general category candidate when Backward Class candidate was available - Not permissible

Common merit list of reserved and unreserved categories should be prepared first and seats should be filled up as per such merit list - Reserved category candidate in such list is to be admitted as general category candidate - after that reserved category candidate should be considered against reserved seats.                         (Source: AIR 1997 Punjab and Haryana 318)
