1 - Bills to Amend the Constitution

1. The Constitution (Amendment) Bill, 1991 (Amendment of Article 350A) - 13.9.1991

Purpose: To provide that it shall be the duty of the State to provide adequate facilities for teaching of and for teaching in mother-tongue at the primary stage of education to children belong to linguistic minority groups.

2. The Constitution (Amendment) Bill, 1991 (Substitution of New Article for Article 81) -22.11.1991

Purpose: To provide that the election of the members to the House of the People shall be held in accordance with the system of proportional representation by means of single transferable vote treating each State or Union territory as a separate multi-member constituency.

3. The Constitution (Amendment) Bill, 1992 (Substitution of New Article for Article 347 etc) -27.3.1992

Purpose: To provide that on a demand being made in that behalf by any linguistic minority with in a State, the President shall direct that such language shall also be recognised throughout that State and also provides that adequate facilities for using the mother-tongue as a medium of instruction at the primary state of education and for teaching the mother-tongue as a compulsory first language at secondary stage of education to children belonging to linguistic minorities shall be made available by the State.

4. The Constitution (Amendment) bill, 1992 (Insertion of New Article 46A) - 7.8.1992

Purpose: To provide that the State shall respect the identity of the religious, linguistic and ethnic minorities and encourage its preservation, promote their educational and economio advancement and protect them against violence.

5. The Constitution (Scheduled Castes) Order (Amendment) Bill, 1992 (Amendment of Paragraph 3) - 30.7.1993

Purpose: To provide that a member of the Scheduled Caste, on conversion to any other religion from the. Hindu, the Sikh or the Buddhist religion, shall continue to receive the benefits which he was entitled to as a member of the Scheduled Caste before such conversion.

6. The Constitution (Amendment) Bill, 1993 (Insertion of New Article 16A) - 17.12.1993

Purpose: To provide that every adult citizen shall have the right to work and to adequate means of livelihood in accordance with his education, skill and experience. It further provides that any citizen who is not provided with employment and who has no adequate means of livelihood shall be entitled to financial relief.

7. The Constitution (Amendment) Bill, 1993 (Amendment of Articles 15 and 16) - 24.2.1994

Purpose: To provide for making of any special provision for the advancement of any identifiable social group which is politically underrepresented in the Legislatures or educationally and economically backward as compared to the national average or which is subject to social discrimination or social disability in any form. It also sought to provide for reservation of posts for any identifiable social group.

8. The Constitution (Amendment) Bill, 1995 (Substitution of New Article for Article 30) -3.6.1995

Purpose: To provide that any section of the citizens professing a distinct religion or having a distinct language, script or culture of its own or forming a distinct social group shall have the right to establish and administer educational institutions of its choice.

9.The Constitution (Amendment) Bill, 1995 (Substitution of New Article for Article 44) -17.8.1995

Purpose: To provide that the State shall endeavour to introduce a model family code which shall apply to the citizens who, or the social groups which, opt for it in lieu of the customary or statutory personal law applicable to them.

10. The Constitution (Amendment) Bill, 1995 (Substitution of Article 345, etc.) - 1.12.1995

Purpose: To provide that the languages, which have been declared as their mother tongue by not less than ten per cent of the population of a State, or of any district, block or panchayat therein, and which have been recognised by the State for educational purposes, shall be declared as additional official languages of the State to be used in administration, for specified purposes, in the State as a whole or in specified parts thereof, as the case may be.

Iqbal's Letters to Jinnah, 21 June, '37 (Extracts)

The enforcement and development of the Shariat of Islam is impossible in this country without a free Muslim state or states. This has been my honest conviction for many years and I still believe this to be the only way to solve the problem of bread for Muslims as well as to secure a peaceful India. If such a thing is impossible in India, the only other alternative is a civil war. A separate federation of Muslim provinces, re-formed on the lines I have suggested is the only course by which we can secure a peaceful India and save the Muslims from the domination of non-Muslims. Why should not the Muslims of north-west India and Bengal be considered as nations entitled to self-determination just as other nations in India and outside India are? Personally I think that the Muslims of north-west India and Bengal ought at present to ignore the non-Muslim provinces. This is the best course to adopt in the interests of both Muslim majority and minority provinces. It will be, therefore, better to hold the coming session of the League in the Punjab, and not in a Muslim minority province.

 

K.K. Khullar On Congress Responsibility for Partition

The genesis of the Indian freedom struggle is no individual, no man or woman but an idea and a concept. It was the culture of India which guided its course.

Freedom did not come to us on a platter nor was it a gift of some benevolent despot. It was the result of a 90-year-old intense struggle based on India's value system and nourished by the blood of martyrs of all faiths from all parts of the country. It was not a result of one individual or group of individuals.

(Mountbatten) had the cheek to tell (Gandhiji) "Mr. Gandhi, today the Congress is with me and no longer with you." Gandhi retorted, "But India is still with me". On June 2, 1947, however, when the viceroy met him Gandhi accepted the partition of India.

"What happened during these 29 days that a staunch supporter and upholder of United India accepted the division of the country which was formerly an anathema to him." Earlier on March 31, 1947 when he had met the new viceroy, Lord Mountbatten for the first time, he had stated to Maulana Azad: "If the Congress wishes to accept partition it will be over my dead body."

The question which arises ... is why did Gandhi not undertake a fast-unto-death, a Satyagraha or a padayatra to mobilise public opinion and stop the process of partition, or was he still the tallest man in the country? "It is important to remember that even in 1947, with one call of Gandhi; the whole of the country would have rallied round him. It is this aspect which has to be examined in a proper historical perspective, clinically and chronologically." "Till such time, therefore, the historical truth is established by a due process of historical research, the partition of India will continue to hang like the proverbial albatross round the parasitic neck of India."
