MHA: Annual Report, 1996-1997 (Extracts) On TADA

The Terrorist and Disruptive Activities (Prevention) Act, 1987 was allowed to lapse on 23rd May, 1995. With a view to ensure that no mis-carriage of justice took place, Review Committees for reviewing each individual case have been set up both at the level of Central Government and State Governments. Instructions have also been issued from time to time to the State Governments and Union Territories emphasising the need to take timely and adequate measures for expeditious investigation and prosecution in TADA cases. Further, the State Governments and Union Territory Administrations have also been requested to issue suitable instructions to their prosecution branches not to seek adjournment in TADA cases and ensure speedy trial.

As a result of periodical reviews undertaken by the Review Committees, TADA cases have been dropped altogether against more than 19,000 persons. As on 30th April, 1996 only 1,986 persons were under detention in various States whereas the number of such persons under detention in January, 1996 was 5,111
