Hashimpura Massacre, 22 May, 1987 Counter-Affidavit of R.R. Pal, Inspector, CB CID, CIS-III, Lucknow dated 13.3.97 Extracts)


 

C.B.C.I.D. conducted investigation of the occurrence relating to 22.5.87 occurred in Mohalla Hashimpura and subsequent to it found that on 22.5.87 at about 8.00 P.M. about 30-42 persons were taken in PAC truck URU 1493 from Mohalla Hashimpura for taking them to P.S. Civil Lines or Police Line, Meerut. But Sri S.P. Singh, P.C., instead of taking them to the above destination carried them upper Gang Nahar, Murad Nagar, Ghaziabad and shot them one by one and threw them into the canal. When some of the detenues tried to escapc they were shot at. During this firing spree one of the occupant of PAC truck Constable Lila Dhar sustained bullet injuries.

Sri Muzeeburahman, Zulfikar Nasir, Naim and Arif were the survival who could come out of the canal by catching the grass. Muzeeburahman lodged oral FIR at P.S. Murad Nagar and. a. case at Crime No. 141/87 U/S 364/307/201 IPC was registered. Injured Kamaruddin expired in the midway. The aforesaid persons have sustained fire Arm injuries. The remaining detenues were taken in the PAC truck URU 1493 to the Hindon Canal (Vill. Makanpur) and the above Platoon commander and PAC men shot them dead. One of the survivals. Babuddin came out of the canal and he lodged FIR at P.S. Link Road which was registered as case Crime No. 110/87 U/S.364/307/302/201 IPC.

C.B.C.L.D. after. completing the investigation identified 13 dead bodies out ef 16 recovered from Hindon river and found 19 officials liabie for the same and cheige sheet was submitted after getting prosecution sanction u/s. 197 Cr.P.C. from the Government on 20.5.96, ...

.. It is submitted that the findings of C.B.C.I.D. were .concluded on 3.8.94. The prosecution for Hashimpura incident was sanctioned on 1.6.95 while the efforts were made to arrest the charged personnels 12 charged PAC personnels place a Cr. Misc. application bearing. No.3827/ 95 before Hon'ble High Court of Judicature at Allahabad.

In the matter Hon'ble Court has given directions for disposing of their bail applications in 3 days time if charged incumbents produce /surrender themselves before Hon'ble court. The petitioner failed in the same and accordingly fhese charged persons werc charge sheeted on 20.5.96 ..: .
