 S.C. Cannot Repeal/Amend Statute

Shahabuddin's Letter to MEA, 6 May, 2000

While the Haj Committee Act; 1959 should be expeditiously replaced by a new Act, which has been on the anvil since 1978, the Order of the Supreme Court on 5 May, 2000 does not make sense to me. The Judiciary can neither repeal nor amend an Act. It was within its right to advise the Executive that some ex-officio members should be dropped or substituted because in the changed circumstances they have no role in the management of Haj. But how can it abolish the Haj Committee itself?
