Government of Andhra Pradesh's Order on Minorities Educational Institutions G.O. No. 23 dated 10.3.1999


 

Government for sometime have been considering the representations regarding certain anomalies and certain difficulties being faced by the Minorities educational institutions due to certain provisions in the Government Orders dealing with Minorities Educational Institutions.

Definition of Religious Minorities Educational Institutions

"A religious Minority Educational Institution shall mean an institution which is run by an agency of which at least 2/3rd members belonging to religious minority.

Provided that atleast 50 per cent of the students in all the classes belong to the concerned minority community excepting when the number of applicants for admissions belonging to that particular community is less than 50 per cent. However, in such a case no applicant belonging to that minority community shall be denied admission and application forms shall not be refused to any candidate.

The aforesaid definition will apply to all Educational Institutions viz. Schools, Colleges, I.T.Is, Polytechnics, Engineering Colleges, Medical Colleges etc.

(However, as far as Engineering and Medical Colleges are concerned, this definition shall be subject to final outcome of relevant cases pending in the Supreme Court)

Authority to Grant Minority Status Certificate

(i) Principal Secretary/Secretary to Government, in Minorities Welfare Department or his nominee shall grant Minority Status Certificate to the Minority Educational Institutions, provided that;

(a) The institution falls within the scope of the aforesaid definition.

(b) To candidate is admitted on the basis of bogus Minority Certificate.

(ii) The certificate shall be issued within 30 days of the receipt of the application.

(iii)The certificate shall be issued after obtaining a report from the respective Commissioners/Directors i.e., School Education/Collegiate Education/Technical Education/Medical Education etc.

(iv) Status Certificate shall be given on permanent basis but if any conditions are violated, stern action shall be taken against the persons responsible and such persons can also be removed from management after due enquiry and the enquiry can be conducted in this regard either on complaint or suo moto by the concerned Department of Minorities Welfare Department.
